Stencil.one is built on top of Amazon Web Services, which is itself compliant with certifications such as SOC 2, CSA, ISO 27001, and more. We also use automated code testing, vulnerability testing (including OWASP Top 10), and continuous monitoring technologies. In the event of a major data loss we also have backups and point-in-time recovery systems built in. We use AWS RDS’s AES-256 encryption to encrypt data at rest. You can see our SSL report test here.

While we take significant measures to protect your data, no system is completely immune to risk. You acknowledge and agree that Stencil.one cannot guarantee absolute security and shall not be held liable for any unauthorized access, data breach, or loss of data beyond our reasonable control.

However, all unique content you create within the Stencil application — including scripts, story documents, shot lists, and storyboards — remains your intellectual property. You retain full ownership of the original content you create. By using Stencil, you grant us a limited, non-exclusive license to store and process your content solely for the purpose of delivering our services to you.

You agree not to copy, reproduce, distribute, republish, download, display, post, or transmit any part of Stencil’s platform, interface, or proprietary systems in any form or by any means without our prior written permission.

Artificial Intelligence Tools — Images, Video, and Music

Stencil includes various AI-powered tools for generating images, video references, and music. These tools are powered by third-party AI providers including but not limited to OpenAI. By agreeing to these Terms, you also agree to the terms and conditions of our underlying AI providers, which can be found at OpenAI’s Terms of Use.

AI-Generated Images

Subject to the content policies of our underlying AI providers, you may own the images you generate within Stencil, including the right to reprint, sell, and merchandise those images. However, ownership and commercial use rights for AI-generated content are subject to ongoing legal developments. “Commercial use” and “copyright” are two separate legal concepts. We strongly encourage you to stay up to date on the latest legal developments regarding AI-generated art by visiting the U.S. Copyright Office website.

Stencil.one makes no representations or warranties regarding the copyright status, ownership, or commercial viability of any AI-generated images produced within our platform. In no event shall Stencil.one, nor any of its officers, directors, or employees, be held liable for anything arising out of or in any way connected with your use of AI-generated images within the Stencil application.

AI-Generated Video

Any AI-generated video content produced through Stencil’s tools is provided for reference and pre-production planning purposes only. You are solely responsible for ensuring that any AI-generated video content you use, distribute, or publish complies with all applicable laws, third-party terms of service, and intellectual property regulations. Stencil.one accepts no liability for claims arising from the use, misuse, or distribution of AI-generated video content created through our platform.

AI-Generated Music

Any AI-generated music or audio content produced through Stencil’s tools is provided for reference and creative planning purposes only. The use of AI-generated music for commercial purposes may be subject to licensing requirements, platform-specific restrictions, and evolving copyright law. You are solely responsible for verifying the rights and permissions associated with any AI-generated audio content before using it in any commercial, public, or distributed work. Stencil.one accepts no liability for any claims, disputes, or damages arising from the use or distribution of AI-generated music or audio created through our platform.

Your Responsibility When Using AI Tools

You agree that you will not use Stencil’s AI tools to generate content that infringes on the intellectual property rights of any third party, depicts real individuals without their consent, violates any applicable law or regulation, or breaches the content policies of our underlying AI providers. Stencil.one reserves the right to restrict or suspend access to AI tools for any user found to be in violation of these terms.

No Warranties

This Website and application are provided “as is” with all faults, and Stencil.one makes no representations or warranties of any kind related to this Website, the application, or the materials contained herein. Nothing contained on this Website or within the application shall be interpreted as professional, legal, or financial advice of any kind.

Limitation of Liability

In no event shall Stencil.one, nor any of its officers, directors, or employees, be held liable for anything arising out of or in any way connected with your use of this Website or application, whether such liability is under contract, tort, or otherwise. Our total liability to you for any claims arising out of or relating to these Terms or your use of our services shall not exceed the amount you paid to Stencil.one in the three months preceding the claim.

Prohibited Uses

• Attempting to gain unauthorized access to any part of our platform or infrastructure

• Engaging in any activity that could damage, disable, overburden, or impair the operation of our services
• Impersonating any person or entity or misrepresenting your affiliation with any person or entity

We reserve the right to suspend or terminate accounts that violate these restrictions at our sole discretion, without notice and without refund.

Indemnification

You hereby agree to indemnify, defend, and hold harmless Stencil.one and its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Website or application, including but not limited to any use of the Website’s content, services, and products other than as expressly authorized in these Terms.

Pricing

The current price listed on the Stencil.one website supersedes any previous pricing. To the extent the price on the website differs from price mentions on any third-party websites, the price on our official website shall prevail. All prices are subject to change without notice. Continued use of the platform after a price change constitutes your acceptance of the new pricing.

Refunds and Cancellations

Stencil.one offers a 7-day refund period from the date of your initial sign-up. If you are not satisfied with your purchase, you may request a full refund within 7 days of your initial payment by contacting us directly. Refund requests made after this 7-day window will not be honored.

Ongoing subscription payments are non-refundable. If you choose to cancel your subscription, you may do so at any time and you will retain access to the platform until the end of your current billing period. No partial refunds will be issued for unused portions of a billing cycle.

Stencil.one reserves the right to terminate or suspend any account found to be in violation of these Terms, without refund.

Severability

If any provision of these Terms is found to be invalid or unenforceable under any applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, deleted without affecting the remaining provisions herein. The remaining provisions of these Terms shall continue in full force and effect.

Privacy

We take your privacy seriously. We will not share your information as a client with any third party unless we have your written approval to do so. Likewise, we will not share any of your project or production details with the public or any third-party companies without your written permission. No Re-Sell

Although Stencil’s software can be white labeled (meaning it can be branded to match the look and feel of a production studio’s website), our software cannot be re-sold. You may not sell, resell, sublicense, rent, lease, or otherwise transfer access to Stencil’s platform or any component of it to any third party. Any attempt to re-sell or re-package our software will result in immediate account termination without refund.

If the Website contains links to other sites and resources provided by third parties, these links are provided for your convenience only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any third-party websites linked from this Website, you do so entirely at your own risk and subject to the terms and conditions of use for such websites. We reserve the right to withdraw linking permission without notice.

Report Content

If you have found content on our site that you feel is potentially harmful to other site visitors, including scams, hateful comments, or illegal material, please contact us immediately and we will investigate all claims promptly.

Stencil.one is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification to you. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms without prior written consent from Stencil.one.

Variation of Terms

Stencil.one is permitted to revise these Terms at any time as it sees fit. By continuing to use this Website after any revisions are made, you are expected to have reviewed and accepted the updated Terms. We will make reasonable efforts to notify users of material changes, but it is your responsibility to review these Terms on a regular basis.

Choice of Law

This Agreement shall be governed by the laws in force in Hong Kong. The offer and acceptance of this contract is deemed to have occurred in Hong Kong. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

Entire Agreement

These Terms constitute the entire agreement between Stencil.one and you in relation to your use of this Website and application, and supersede all prior agreements, representations, and understandings. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
